Information on the transfer of obligations concerning the registration, transfer, recognition, application and cancellation of guarantees of origin for electricity from renewable energy sources and energy produced by high-efficiency co-generation

The Regulatory Office for Network Industries ("the Office") informs you that on 1 January 2020 the activities related to the registration, transfer, recognition, application and cancellation of guarantees of origin of electricity from renewable energy sources and energy produced by high-efficiency co-generation were transferred from the Office to OKTE, a.s. as the short-term electricity market organiser. This change occurred on the basis of Act No. 309/2018 Coll. amending Act No. 309/2009 Coll. on the Promotion of Renewable Energy Sources and High Efficiency Co-Generation as amended.

Pursuant to the transitional provision of Section 18j (2) of Act No 309/2009, proceedings on the issuing, transfer, cancellation or recognition of guarantees of origin for electricity from renewable energy sources and electricity produced by high-efficiency combined heat and power generation commenced before 1 January 2020 shall be terminated in accordance with the provisions of this Act in the version in force until 31 December 2019. Proceedings on the issuing, transfer, cancellation or recognition of a guarantee of origin commenced in this way shall be completed after 31 December 2019 by the Office.

Since January 1, 2020, the electronic issuance, transfer, application and cancellation of guarantees of origin has been implemented in accordance with the standards of the European platform of the Association of Issuing Bodies (AIB) in the electronic system of OKTE, a.s. This implementation will also ensure the recognition of guarantees of origin issued in another EU Member State and the organisation of auctions for guarantees of origin for electricity for which the right to feed-in-tariff or feed-in-premium has been exercised.

At the same time, guarantees of origin issued in an EU Member State other than an AIB Member State will also continue to be recognised and transferred, provided that such guarantee of origin meets the requirements of Section 8b(10) of Act No 309/2009 Coll., according to which OKTE shall recognise and register a guarantee of origin issued in another Member State on the basis of a mechanism guaranteeing accuracy and reliability.
