Decisions on terms, conditions and methodologies according to network codes for SEPS and OKTE

The network codes collectively refer to a package of eight Commission (EU) regulations issued under Regulation (EC) No 714/2009 on conditions for access to the network for cross-border exchanges in electricity. These regulations represent network codes or guidelines, which can be grouped into three categories:


Market Related Codes set out the competence of the Office (as a national regulatory authority) to approve terms, conditions and methodologies according to:

  • Commission Regulation (EU) 2015/1222 of 24 July 2015 establishing a guideline on capacity allocation and congestion management (CACM),
  • Commission Regulation (EU) 2016/1719 of 26 September 2016 establishing a guideline on forward capacity allocation (FCA),
  • Commission Regulation (EU) 2017/2195 of 23 November 2017 establishing a guideline on electricity balancing (BAL).


System Operation Related Codes set out the Office's competences to approve terms, conditions and methodologies according to:

  • Commission Regulation (EU) 2017/1485 of 2 August 2017 establishing a guideline on electricity transmission system operation (SO),
  • Commission Regulation (EU) 2017/2196 of 24 November 2017 establishing a network code on electricity emergency and restoration (ER).


Grid Connection Related Codes provide the Office with competences in three areas - granting derogations, classifying generation facilities as emerging technologies, deciding on generally applicable requirements for connection:

  • Commission Regulation (EU) 2016/631 of 14 April 2016 establishing a network code on requirements for grid connection of generators (RfG),
  • Commission Regulation (EU) 2016/1388 of 17 August 2016 establishing a network code on demand connection (DCC),
  • Commission Regulation (EU) 2016/1447 of 26 August 2016 establishing a network code on requirements for grid connection of high voltage direct current systems and direct current-connected power park modules (HVDC).


CACM, FCA, BAL, SO and ER network codes set out the competences of the Office in the area of approval of terms, conditions and methodologies submitted to the Office by SEPS, the transmission system operator, or OKTE, the short-term electricity market operator. The network regulations or guidelines set out a total of more than 100 regional or European terms, conditions and methodologies, which have been approved on an ongoing basis since 2016. If a decision on the approval of the relevant methodology is not issued by the Office in coordination with the national regulatory authorities on regional or pan-European level, then the competent authority to issue and publish the decision on its website is ACER.
